Motorola Locking Down Droid X Leak Using Cease and Desist Scare Tactics

Were you thinking about installing a little bit of leaked Froyo on your Droid X? If so, you might want to read this post.  According to the folks over at at MyDroidWorld ,  they have received a Cease and Desist notice from the head of Motorola Information Security demanding they take the leaked version of Froyo for the Droid X down from their servers (other sites have also received this same notice). While this may just be a tactic to protect customers, one thing is certain: they want the files down ASAP and wil use any means necessary.  Given the company’s history, I wouldn’t be surprised if the reason was purely regarding intellectual property.  See the full notice below. Pursuant to 17 USC 512(c)(3)(A), this communication serves as a statement that: (1). I the duly authorized representative of the exclusive rights holder Motorola for  Droid X Keyboard Software, know as “repackaged-signed.apk” The follow URL contains the software which we have confirmed as Motorola Copyrighted Software http://www.xxxxxxxxx.com/downloads/update.zip (2). These exclusive rights are being violated by material available upon your site at the following URL(s): http://www.xxxxxxxx.com/downloads/update.zip (3) I have a good faith belief that the use of this material in such a fashion is not authorized by the copyright holder, the copyright holder’s agent, or the law; (4) Under penalty of perjury in a United States court of law, I state that the information contained in this notification is accurate, and that I am authorized to act on the behalf of the exclusive rights holder for the material in question; (5) I may be contacted by the following methods: Richard Rushing Senior Director Information Security Motorola xxxxxxxx@xxx.com Office xxx-xxx-xxxx Mobile xxx-xxx-xxxx I hereby request that you remove or disable access to this material as it appears on your service in as expedient a fashion as possible. Thank you for your kind cooperation. Richard Rushing Motorola Senior Director Information Security xxxxxx@motorola.com Office xxx-xxx-xxxx Mobile xxx-xxx-xxxx As Android is open source, Motorola is using the Droid X’s copyrighted software to argue that the software as a whole needs to be pulled down as soon as possible. Quite clever. It would be interesting to see their response if someone removed the the copyrighted pieces of  UI only.  I have to think that they would have less of an argument for removal. Overall, I am not sure how serious Motorola is, but these gestapo scare tactics usually work. In fact they seemingly have as the .zip file has already been removed from MyDroidWorld. Try to find it while you can. Do these tactics anger you? Is Motorola out of line? Do you believe they made a mistake
